This page outlines the terms and conditions on which we will supply to you dinner and wine boxes
(products or services) for the subscriptions (subscriptions) listed on our website
www.dailydish.co.za (website). Please read these terms and conditions carefully.
You understand that by ordering any of our Products or subscribing to one of our
Services, you agree to be bound by these terms and conditions.
1. Disclaimer
The information contained in this site is provided in good faith and is on an as
is basis. The information is believed to be accurate and current at the date the
information was placed on this website.
2. Service Availability
- Our site is only intended for use by people residing in South Africa and is limited
to the delivery areas specified on the website. We do not accept orders from individuals
outside South Africa.
- No alcohol sales to anyone under the age of 18. If you purchase alcohol via our website,
you confirm that you are 18 years of age or older
3. Weekly Subscription Contract
- By subscribing to the Daily Dish service you agree to receive products
for your chosen subscription on a recurring basis every week and you are agreeing
to pay recurring periodic subscriptions for an indefinite time until cancelled by
you or us. You can cancel or interrupt your subscription at any time (see Service
Cancellation or Interruption clause 11. below).
- The weekly subscription amount will be automatically charged to
the credit card you select every Wednesday at 11am.
4. Credit Card Acquiring - Payment Gateway
Credit Card Transactions are acquired by Virtual Card Services (Pty) Ltd, a registered
systems operator and payment gateway in South Africa. View Virtual Card Service's security and privacy policy here. Your credit card
details will, in accordance with legislation, be kept secure and not be accessible
by any unauthorised individual.
5. Delivery Terms
- The delivery service covers the selected suburbs listed on the website. Deliveries are made between 8am and 5pm.
- You may amend your address details on the website up until 24 hours before the delivery day.
- If we are unable to deliver to the specified address for whatever reason, we'll attempt to contact you on the contact number on your Daily Dish profile page to make an arrangement to deliver. We'll endeavour to make every effort to deliver up to a maximum of two attempts, but should this not be possible for whatever reason, you agree to forfeit your box with no refund.
- You will not hold us responsible for any delays, outside our control, which relate to the delivery of your orders.
- It is your responsibility to report all lost deliveries to us within 24 hours. Failure to do so will result in no refund.
6. Risk and Title
- The products will be at your risk from the time of delivery
- Ownership of the products will only pass to you when we receive full
payment of all sums due in respect of the products.
7. Price and Payment
- Prices are inclusive of Value added tax at the rate of 15%.
- The price of the products will be as quoted on our site from time to
time, except in cases of obvious error.
- Product prices are liable to change at any time, but changes will not
affect orders which have already been placed and paid for.
- Orders will not be dispatched unless payment has been successfully
processed.
8. Substitutions
- We will endeavour to deliver food ingredients and wine (including vintage) as advertised every week.
However, should a certain ingredient or wine be unavailable on the day we order, then we reserve the right to substitute
the dish, or ingredient, or wine for a similar dish, or ingredient, or wine.
- The year quoted on the wine bottle is for reference only. Vintages are subject to change without warning.
9. Waivers
- You are solely responsible for the proper and safe washing, handling, preparation, storage, cooking,
use and consumption of the products you receive from us. You are also solely responsible for
knowing about any food allergies you may have and verifying the products and their contents before
handling, preparing, using or consuming such products. Further, you understand, acknowledge and
agree that we store, portion and package products containing all major allergens (milk, wheat, egg,
soy, fish, shellfish, peanuts and treenuts) and cannot guarantee that cross-contamination will not
occur between products.
10. Promotion Codes
- From time to time we offer promotional discounts in the form of a promotion code.
Promotion codes are limited to one code per customer and can only be used on the first order.
11. Service Cancellation or Interruption
- To cancel or interrupt your subscription, you must logon to Daily Dish
and click on the pause button on the Subscription page. Your subscription will be
cancelled immediately and no further payments will be scheduled unless you choose
to resume your service. Any Daily Dish boxes that are already in the delivery cycle
cannot be cancelled or refunded.
- We reserve the right at our absolute discretion not to renew your subscription
at any time.
12. Refunds Policy
- If you are dissatisfied with any product you receive from us, please
contact us at support@dailydish.co.za. We retain the right to request a return of
any faulty goods to us where the product will be inspected. If the fault is agreed,
a full refund will be given for the returned goods. We will consider refunds for
any deliveries returned to us within 1 day of receipt. We reserve the right to refuse
a refund on any product.
- If you choose to cancel or interrupt your subscription, any Daily
Dish boxes that are already on order and in the delivery cycle cannot be cancelled
or refunded.
13. Intellectual Property Rights
- We are the owner or the licensee of all intellectual property rights
in our site, whether registered or unregistered, and in the material published on
it. These works are protected by copyright laws and all such rights are reserved.
- You may print off one copy, and may download extracts, of any pages
from our site for your personal reference. You must not use any part of our copyright
materials for commercial purposes without first obtaining a licence to do so from
us and our licensors.
- If you post comments on the Products or Services to any website, blog
or social media network (Commentary) you must ensure that such Commentary represents
your fairly-held opinions. By subscribing to the Services you irrevocably authorize
us to quote from your Commentary on our site and in any advertising or social media
outlets which we may create or contribute to.
14. Choice of Law
Contracts for the purchase of products through our site and any dispute or claim
arising out of or in connection with them or their subject matter or formation (including
non-contractual disputes or claims) will be governed by South African law.
15. Our right to vary these Terms and Conditions
We have the right to revise and amend these terms and conditions from time to time
to reflect changes in market conditions affecting our business, changes in technology,
changes in payment methods, changes in relevant laws and regulatory requirements
and changes in our system's capabilities.
